These Terms & Conditions (“Terms”) govern your access to and use of the Imagine Seeds website, products, and services (collectively, the “Services”), and any purchase you make from Imagine Seeds LLC (“Imagine Seeds,” “we,” “us,” or “our”). By accessing our website or placing an order, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Services.

1. Eligibility and Scope of Use

Our Services are intended for use by individuals located in the United States and are offered for home gardening purposes only. Our products are not intended for commercial agricultural use.

You must be at least 18 years old to make a purchase from our website.

2. Orders and Acceptance

All orders placed through our website are subject to acceptance by Imagine Seeds. We reserve the right to refuse or cancel any order for any reason, including but not limited to inventory limitations, pricing errors, suspected fraud, or violations of these Terms.

Order confirmation does not constitute acceptance of an order. Acceptance occurs when the order is shipped.

3. Pricing and Errors

All prices are listed in U.S. dollars. We reserve the right to correct any pricing, typographical, or other errors, even after an order has been submitted. If an error affects your order, we may cancel the order and issue a refund.

4. Shipping

We ship to U.S. addresses only. Shipping timelines are estimates and are not guaranteed. Risk of loss and title to products pass to you upon shipment.

5. Refunds and Replacements (No Returns)

We stand behind the quality of our seeds and are committed to customer satisfaction.

  • We do not accept physical returns of seed packets.
  • If you are dissatisfied with your purchase, you may contact us within 60 days of shipment.
  • At our discretion, we may offer a replacement or refund to the original payment method.

Store credit is not offered at this time.

Seeds are living products, and germination and performance depend on many factors beyond our control. Results may vary based on growing conditions, climate, soil, and care.

The remedies described in our 100% Satisfaction Guarantee constitute the purchaser’s exclusive remedy.

6. Product Use and Performance Disclaimer

All seeds sold by Imagine Seeds are intended for home gardening use only. We do not guarantee specific results, yields, or performance.

To the fullest extent permitted by law, Imagine Seeds disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose, except as expressly stated in our Satisfaction Guarantee.

7. Intellectual Property

All content on our website, including text, images, product descriptions, logos, and educational materials, is the property of Imagine Seeds or its licensors and is protected by intellectual property laws.

You may share our content for non-commercial purposes only, provided it is properly attributed and not modified. Any other use requires our prior written consent.

8. Customer Accounts and Conduct

Customer accounts are optional. We reserve the right to suspend or terminate accounts or refuse service if we believe a customer has engaged in fraud, abuse, misuse of the Services, or violation of these Terms.

9. Limitation of Liability

To the fullest extent permitted by law, Imagine Seeds’ total liability for any claim arising out of or relating to the Services or products shall not exceed the amount paid by you for the product giving rise to the claim.

You agree to indemnify and hold harmless Imagine Seeds from any claims, damages, losses, or expenses arising out of your violation of these Terms or misuse of the Services.

11. Arbitration and Class Action Waiver

Any dispute or claim arising out of or relating to these Terms, the Services, or any products purchased shall be resolved by binding arbitration, rather than in court.

  • Arbitration shall be conducted on an individual basis.

  • Arbitration shall be governed by the Federal Arbitration Act and administered by a recognized arbitration provider.
  • The arbitration shall take place in Pennsylvania, unless otherwise required by law.

You and Imagine Seeds waive any right to a trial by jury.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

13. Force Majeure

We are not liable for delays or failures resulting from events beyond our reasonable control, including weather events, postal delays, supply chain disruptions, or acts of God.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on our website with an updated “Last Updated” date. Continued use of the Services constitutes acceptance of the revised Terms.
